TERMS OF SERVICE

OVERVIEW

This website and online store are operated by Hope and Project (Pty) Ltd, registration number 2021/652169/07, trading as Baby Hour.

Throughout these Terms of Service, the words “Baby Hour”, “we”, “us” and “our” refer to Hope and Project (Pty) Ltd trading as Baby Hour. The words “you”, “your” and “customer” refer to any person who visits our website, uses our services or purchases our products.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Return and Refund Policy and Shipping Policy.

These Terms are governed by South African law. Nothing in these Terms limits any consumer right or remedy that cannot legally be excluded, including rights under the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.

1. ELIGIBILITY AND ACCOUNTS

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order. A person under 18 may use the website only with the permission and supervision of a parent or legal guardian.

You agree to provide accurate, complete and current account, contact, billing and delivery information.

You are responsible for protecting your account details and password. Please notify us promptly if you believe that your account has been accessed without permission.

You may not use our website or services for any unlawful, fraudulent or unauthorised purpose.

1. OUR PRODUCTS

Baby Hour offers baby-and-kids products, educational materials, learning devices, toys, books, activities, electronics, tablets and related products.

We take reasonable steps to ensure that product descriptions, specifications, photographs, dimensions, colours and prices are accurate. However, colours and appearance may vary depending on lighting, photography and your device’s display settings.

Images may include styling items that are not included with the product. Please review the full product description and “What’s Included” information before ordering.

We may update, improve, replace or discontinue products without prior notice. Product availability remains subject to stock levels.

1. CHILD SAFETY AND ADULT SUPERVISION

Age recommendations are provided as general guidance. Parents and caregivers are responsible for selecting products appropriate for each child’s age, abilities and developmental stage.

Products must be used according to their instructions and safety warnings. Adult supervision may be required, particularly where products contain small parts, electronic components, batteries, cables or accessories.

Nothing in this section excludes any responsibility that Baby Hour has under applicable consumer-product and safety laws.

1. ELECTRONIC PRODUCTS AND TABLETS

The performance of electronic products may vary depending on settings, applications, network access, screen brightness, charging habits and usage.

Advertised device storage may differ from usable storage because the operating system, system files and pre-installed applications use part of the total capacity.

Battery-life figures are estimates and may vary according to use. Compatibility with every third-party application, mobile network, accessory or internet service is not guaranteed.

Electronic products must be operated, charged and maintained according to their instructions. Damage caused by misuse, accidental impact, liquid exposure, incompatible chargers or accessories, unauthorised repairs, physical alterations or failure to follow the instructions may not qualify as a manufacturing defect.

This section does not limit any rights relating to faulty, unsafe or defective goods under South African law.

1. PRICES AND PAYMENT

All prices are displayed in South African rand unless stated otherwise.

Delivery fees and other applicable charges will be shown before checkout or communicated before the order is confirmed.

We may change prices, promotions and discounts without prior notice. Changes will not affect orders that we have already accepted and confirmed.

Payment must be completed or authorised before an order is processed unless Baby Hour has approved a different arrangement in writing.

You confirm that you are authorised to use the payment method submitted with your order.

1. ORDERS AND ACCEPTANCE

Placing an order constitutes an offer to purchase. An order is accepted once payment has been confirmed and Baby Hour has issued an order confirmation or begun processing the order.

We may decline or cancel an order where:

• A product is unavailable
• Payment cannot be verified or authorised
• The product or price contains an obvious error
• The customer’s information is incorrect or incomplete
• We reasonably suspect fraud or unlawful activity
• Delivery cannot reasonably be completed
• The order breaches these Terms

If we cancel a paid order, we will refund the amount received through the original payment method.

Please check your order carefully before submitting it. If you need to make a change or cancellation, contact us as soon as possible. Changes may not be possible after an order has been packed or dispatched.

1. BUNDLES, COMBOS AND PROMOTIONAL GIFTS

Products sold as a bundle or combo must ordinarily be returned together with all included items, accessories and promotional gifts.

If an approved return is incomplete, any refund may be adjusted by a reasonable amount reflecting the missing items, subject to applicable law.

Promotional offers are valid only for the stated period and while stock lasts. Unless expressly stated otherwise, discount codes may not be combined.

1. RESELLERS AND WHOLESALE ORDERS

Products purchased for resale, wholesale distribution or another commercial purpose may be subject to separate written reseller or wholesale terms.

These Terms apply to ordinary retail purchases unless Baby Hour and the purchaser have agreed to separate commercial terms in writing.

Nothing in this section removes rights that legally apply to a particular transaction.

1. SHIPPING AND DELIVERY

Delivery methods, estimated timeframes and charges are described in our Shipping Policy and at checkout.

Delivery dates are estimates unless expressly confirmed as guaranteed. Delays may occur due to courier operations, severe weather, strikes, public holidays, incorrect customer information or circumstances beyond our reasonable control.

Customers are responsible for providing an accurate delivery address and contact details and for remaining available to receive or collect their orders.

If a parcel is returned because the address was incorrect, delivery was repeatedly unsuccessful or the collection period expired, the customer may be responsible for reasonable redelivery charges, except where the failure was caused by Baby Hour or the courier.

Risk in the goods remains with Baby Hour until the order is delivered to you or a person authorised to receive it, subject to applicable law.

1. RETURNS, REFUNDS AND EXCHANGES

Returns, refunds and exchanges are handled according to our Return and Refund Policy and applicable South African law.

Please inspect your order after delivery and notify us promptly if it is damaged, defective, incomplete or different from what you ordered.

Nothing in these Terms limits your legal rights regarding incorrectly supplied, unsafe, unsuitable or defective goods.

1. ERRORS AND INACCURACIES

Our website may occasionally contain typographical errors, inaccurate information or omissions relating to descriptions, prices, promotions, delivery charges, availability or specifications.

We may correct genuine errors and update information. If an error materially affects an order you have already placed, we will contact you and provide an appropriate option, which may include confirming the corrected order or receiving a refund.

1. INTELLECTUAL PROPERTY

The Baby Hour name, logo, branding, photographs, graphics, videos, product descriptions, website design and written content are owned by or licensed to Hope and Project (Pty) Ltd.

You may not copy, reproduce, modify, distribute, publish, sell or commercially use our content without prior written permission.

You may use the website only for lawful personal or authorised commercial purposes.

1. REVIEWS AND CUSTOMER CONTENT

If you submit a review, photograph, video, testimonial, comment or other content, you confirm that:

• The content is truthful and reflects your genuine experience
• You own the content or have permission to share it
• It does not infringe another person’s rights
• It is not unlawful, abusive, misleading or offensive

You grant Baby Hour a non-exclusive, royalty-free permission to display and use content you voluntarily submit for operating and promoting the business, unless otherwise agreed in writing.

We may remove content that violates these Terms or applicable law.

1. PROHIBITED USES

You may not:

• Use the website for unlawful or fraudulent activity
• Provide false, misleading or harmful information
• Attempt to access another customer’s account
• Upload viruses, malicious code or harmful content
• Interfere with the website’s security or operation
• Copy or exploit our content without permission
• Collect another person’s information unlawfully
• Infringe our intellectual property or the rights of another person
• Impersonate another person or organisation

We may restrict or terminate access where these Terms are materially breached.

1. THIRD-PARTY SERVICES AND LINKS

Our website may use or link to third-party payment providers, couriers, applications, websites and services. Those services may have their own terms and privacy policies.

We are not responsible for independent third-party content or services, except where liability cannot legally be excluded.

Baby Hour is powered by Shopify, which enables us to provide the online store and related services. However, all purchases are made directly from Hope and Project (Pty) Ltd trading as Baby Hour. Shopify is not the seller of our products.

1. PRIVACY AND PERSONAL INFORMATION

We collect and process personal information according to our Privacy Policy and applicable South African data-protection law.

By placing an order, you authorise us to share information reasonably necessary to process payment, fulfil your order, provide customer service and arrange delivery with relevant service providers.

Because Shopify hosts our online store, certain information may also be processed by Shopify and its authorised service providers according to their applicable privacy terms.

1. WEBSITE AVAILABILITY

We take reasonable steps to keep the website accurate, secure and available. However, we do not guarantee uninterrupted access or that the website will always be free from technical errors.

We may temporarily suspend access for maintenance, security, upgrades or circumstances outside our reasonable control.

1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Baby Hour will not be liable for indirect or consequential loss arising from the use of the website or products.

Baby Hour is not responsible for loss resulting from customer misuse, unauthorised alterations, failure to follow product instructions or use of incompatible third-party accessories.

Nothing in these Terms excludes or limits liability, statutory warranties or consumer remedies that cannot legally be excluded under South African law.

1. INDEMNITY

To the extent permitted by law, you agree to indemnify Hope and Project (Pty) Ltd against third-party claims or losses resulting directly from your unlawful use of the website, material breach of these Terms or infringement of another person’s rights.

1. TERMINATION

We may suspend or terminate access to our services where you materially breach these Terms, misuse the website or engage in fraudulent or unlawful conduct.

Rights and obligations arising before termination will continue to apply where appropriate.

1. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.

1. ENTIRE AGREEMENT

These Terms, together with the policies referenced in them and any written terms applicable to a specific order or promotion, constitute the agreement between you and Baby Hour concerning your use of the website and retail purchases.

1. CHANGES TO THESE TERMS

We may update these Terms when our business, services or legal obligations change.

The latest version will be published on this page with its updated date. Revised Terms will apply to future website use and purchases from their effective date, subject to applicable law.

1. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Republic of South Africa.

The parties should first attempt to resolve a dispute by contacting each other directly. Where a dispute cannot be resolved, either party may approach an appropriate South African court, consumer authority, tribunal, ombud or alternative dispute-resolution body with jurisdiction.
